This Privacy Policy explains how Culdesac Inc., Culdesac Living LLC, and their affiliates ("Culdesac," "we," "us," or "our") collect, use, and share information when you visit culdesac.com and its subdomains, lapalomatempe.com, 1070dill.com, or 1121allene.com (together, the "Site") or otherwise interact with us in connection with our communities. It applies to visitors, prospective residents, and anyone who contacts us through the Site.
If you apply to live at a Culdesac community, sign a lease, or use a resident portal, that process runs on a platform operated by Entrata, Inc. Entrata's own Terms of Use govern your use of that platform, and Entrata acts as our service provider for the information you submit there. Section 4 below explains this in more detail.
1. What we collect
Information you give us. We collect what you choose to provide when you:
- Request a tour or express interest in a community: your name, email address, phone number, and any preferences or notes you include.
- Sign up for our newsletter or updates: your email address.
- Contact us by email, phone, or a contact form: your contact details and the contents of your message.
- Apply for a home, sign a lease, or use a resident portal through Entrata: application and leasing information as described in Section 4.
Information collected automatically. When you visit the Site, our web host and content delivery network automatically record standard server log information: your IP address, browser type, device type, the pages you request, the date and time of the request, and the referring page. We use this information to operate and secure the Site and to understand aggregate traffic patterns. Some pages load fonts from Google, and the La Paloma map page embeds Google Maps; Google receives your IP address for those requests.
What we do not collect. The Site does not use third-party advertising pixels, analytics trackers, session-replay tools, or social media tracking tags. We do not set cookies for advertising or cross-site tracking. The only cookies the Site uses are those strictly necessary for it to function (for example, remembering a form you started). We do not sell personal information, and we do not share it with third parties for their own advertising purposes.
2. How we use information
We use the information described above to:
- Respond to your tour requests, questions, and messages.
- Send you the newsletter or updates you signed up for, and information about availability, pricing, events, and community news that we think will interest you. You can opt out at any time (see Section 6).
- Send transactional and service messages, such as tour confirmations and appointment reminders.
- Operate, secure, maintain, and improve the Site.
- Detect, prevent, and respond to fraud, abuse, and security incidents.
- Comply with law, respond to legal process, and protect our rights and the rights and safety of our residents, employees, and others.
3. Text messages and calls
If you provide a phone number and agree to receive text messages or calls from us, we may contact you about your inquiry, tours, availability, and related updates, including by automated means where you have consented. Message and data rates may apply. You can stop text messages at any time by replying STOP, and you can ask us to stop calling by contacting us at the address in Section 8. Consent to receive marketing texts or calls is not a condition of leasing or of any purchase.
4. Leasing, applications, and resident portals (Entrata)
Applications, lease signing, payments, maintenance requests, and resident accounts are handled through a platform provided by Entrata, Inc. ("Entrata"). Pages on that platform, including prospectportal.culdesac.com and culdesac.residentportal.com for Culdesac Tempe and lapalomatempe.prospectportal.com and lapalomatempe.residentportal.com for La Paloma, are operated by Entrata on our behalf.
When you use that platform, you may be asked to provide information needed to evaluate an application and administer a lease, such as your date of birth, Social Security number or other government identifier, employment and income information, rental history, emergency contacts, vehicle information, and payment details. Entrata processes this information as our service provider and may also engage screening and payment processors. Consumer reports obtained in connection with an application are handled in accordance with the Fair Credit Reporting Act and applicable state law.
Your use of the Entrata platform is also subject to Entrata's Terms of Use, which are linked from those pages. Entrata may set cookies or use similar technologies on its platform; its cookie preferences control is available in the footer of those pages. Questions about how Entrata handles information can be directed to us at the address in Section 8 and we will coordinate with Entrata.
5. How we share information
We do not sell personal information and do not share it with third parties for their own marketing. We share information only:
- With service providers that help us operate. These currently include our web host and content delivery network, our email and text-messaging provider, our customer-relationship management provider (HubSpot, which also hosts our tour-scheduling pages and the contact forms on our Atlanta property pages), and Entrata and its screening and payment processors. Each is permitted to use your information only to provide services to us.
- Among Culdesac entities, including Culdesac Inc., Culdesac Living LLC, and the affiliates that own or operate the community you inquire about.
- With property owners, lenders, and investors in the communities, in aggregate or as required by our agreements with them, and in de-identified form wherever practical.
- For legal reasons, when we believe in good faith that disclosure is required by law, subpoena, or court order, or is necessary to protect the rights, property, or safety of Culdesac, our residents, or others.
- In a business transaction, such as a merger, financing, or sale of a community or of all or part of our business, in which case the recipient will be bound by this Policy with respect to information transferred.
6. Your choices
Marketing email. Click "unsubscribe" in any marketing email, or contact us at the address in Section 8.
Text messages. Reply STOP to any message.
Access, correction, and deletion. You may ask us to provide, correct, or delete the personal information we hold about you by contacting us at the address in Section 8. We may need to verify your identity before acting on a request, and we may retain information we are required to keep by law or that is needed for a lease, an application in progress, or a legitimate business record.
Do Not Track and Global Privacy Control. Because the Site does not track visitors across other websites or share information for targeted advertising, there is nothing for these browser signals to switch off. We honor them by default.
7. Other things you should know
Children. The Site is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has provided us information, contact us and we will delete it.
Security. We use reasonable administrative, technical, and physical safeguards to protect personal information. No system is completely secure, and we cannot guarantee the security of information transmitted over the internet.
Retention. We keep personal information for as long as needed for the purposes described in this Policy, to comply with legal, accounting, and reporting obligations, and to resolve disputes. Inquiry and tour information is typically retained for 24 months after your last contact with us unless you become a resident or ask us to delete it sooner.
Links to other sites. The Site may link to websites we do not control, including local businesses and community partners. Their privacy practices are their own, and this Policy does not apply to them.
Changes to this Policy. We may update this Policy from time to time. We will post the revised Policy on the Site with a new "Last Updated" date and, for material changes, provide additional notice such as an email or a notice on the Site.
